When can a GST Refund Be Claimed?

A refund may arise from exports or SEZ supplies, an inverted duty structure, excess cash-ledger balance, tax paid by mistake, a favourable order or deemed exports. Zero-rated suppliers may claim eligible unutilised ITC when exporting under a bond or Letter of Undertaking.

For the exports made with payment of IGST, the shipping bill generally acts as the refund application once the export manifest and valid GST returns have been filed. The same export supplies cannot be used to claim a refund under both routes.

GST Refund Process in India

  1. Check Eligibility and Limitation
    Identify the category, tax period, and “relevant date.” Under Section 54 of the CGST Act, most claims must be filed within two years from that date, which varies by category.

    Match the GSTR-1, GSTR-3B, invoices, ITC, and the export data. Confirm and verify the amount using the prescribed formula.
  1. File Form GST RFD-01
    On the GST portal, select the category, complete the GST refund RFD-01 form in India, upload documents, and submit using DSC or EVC. Successful filing generates an Application Reference Number.
  1. Respond to the Departmental Communication
    The officer may issue the RFD-02 acknowledgement or RFD-03 deficiency memo. A deficiency normally requires a fresh and corrected application. The proposed rejection is basically communicated in RFD-08; the applicant may reply in RFD-09.
  1. Sanction and Payment
    The decision is issued in RFD-06, and the sanctioned amount goes to the validated bank account. Under Section 54, the proper and authorised officer should sanction the eligible refund within 60 days of receipt of a complete application. The interest may become payable under Section 56 when an admissible refund is delayed beyond the given provided prescribed period.

  • GST refund computation and the prescribed statements;
  • Relevant tax invoices and the debit or credit notes;
  • GSTR-1 and the GSTR-3B details;
  • Shipping bills and export manifest details for goods;

A GST refund bank account mismatch can delay the payment. Refund may also be withheld where the returns are pending, tax is recoverable, or an appeal or investigation affects the claim.
